IMPHAL, June 30: The director cum commissioner (disabilities) of social welfare department has failed to implement the provisions of section 33 and 39 of the persons with disabilities Act, 1995, alleged a release of the All Tribal Disables’ Union Manipur.
A release of the All Tribal Disables’ Union Manipur (ATDUM) stated that the director of social welfare has notified the advertisement for recruitment of various posts without leaving reservations for physically challenged persons.
The notified posts include Staff to State Project Support Unit (SPSU), State Child Protections Society (SCPS), District Child Protection Society (DCPS) and Observation Home (OH). The provision of section 33 and 39 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995, states “every appropriate Government shall appoint in every establishment such percentage of vacancies not less than three per cent for the physically challenged persons”.
It has further informed that with respect to the violation of the provisions in the act and negligence by the responsible commissioner, a writ petition has been filed against the director cum commissioner (disabilities) before the Gauhati High Court, Imphai Bench for necessary direction and action. Thereupon, the High Court suspended the advertisement/notice of the recruitment until further orders on March 16, maintained the release.
The release of ATDUM further stated that there have been certain complaints from disabled persons regarding the non-acceptance of their application forms without income certificate of the persons. Unlike the previous years the authorities are demanding income certificates from individuals applying for disability certificate.
Considering the problems of handicapped persons to obtain their Income Certificate from the concerned SDC/SDO/DC, it is not provisional or mentioned in the disabilities act 1995, as well as the impugned order harasses the physically challenged persons, it charged.
Disability Certificate is mandatory for every physically challenged person so there is no reason for objection to physically challenged persons while applying for their certificate without income certificate, it mantained.
The ATDUM also appealed to the concerned authorities to revoke the order which are made mandatory for physically challenged persons to enclose income certificate while applying for their disability certificate, added the release.
