Ukl DC fined for not furnishing RTI information

IMPHAL July 6: The deputy commissioner of Ukhrul who is also the concerned State Public Information Officer (SPIO) has been directed to pay a fine of Rs 25,000 to an RTI appellant for not furnishing sought information on time.

Yardeo Leisan, a resident of Seikhor village, Ukhrul district under the RTI act sought information from the DC regarding MGNREGS work in respect of Seikhor under LM. Block with effect from March 1 till date.

He submitted his appeal to the DC on March 3, 2010.

His application also sought information regarding muster-rolls, social audit vouchers and APRs of material components, details of wage payment and cash transactions through banks, upto date job cards, work orders, technical sanction orders, original estimates and photos of work sites.

The certified copies according to the RTI Act, 2005 should be made available to the appellant by the SPIO within one month time.

As the information was not received, Yardeo Leisan approached the Manipur Information Commission on December 13, 2010 and filed a complaint with the regard.

On the basis of the complaint, the commission also served a show cause notice to the DC and on getting no response from the concern it was finally taken up as a complaint case.

Under section 18 of the RTI Act, the case was registered and hearings were conducted on January 28, 2011, Feburary 8, February 28, April 30 and May 6 of the current year.

Finally out of the ten components sought by the appellant, only two components were tendered by the DC incurring a delay of more than four months.

In the issue, the appellant had also sought compensation for non cooperation from the concerned DC/ SPIO. The State Chief Information Commissioner Rk Angousana on June 20 last, directed the SPIO to pay a fine of Rs 25,000 within ten days of receipt of the directive and further to furnish the sought information within a week.
