NIA Spl court rejects petition to transfer Meghen to Tihar jail

GUWAHATI, Sept 26: The Special Court of National Investigation Agency (NIA) Guwahati has today rejected the petition filed by the ministry of home affairs requesting permission to transfer UNLF chairman RK Meghan to Tihar Jail, New Delhi.

According to reports, the ministry on July 26 sent a written statement to the Superintendent of the Guwahati Jail requesting permission to transfer the rebel leader from Guwahati Jail to Tihar Jail New Delhi. Subsequently the issue was placed before the NIA special court by the Jail SP.

According to Moirangthem Gunadhor, the counsel appearing on behalf of Meghen, the court gave the judgment today after hearing was held twice in connection with the transfer issue at the NIA special court Guwahati.

During the hearing, DK Das the counsel of the NIA made allegation stating that Meghen continues to operate from inside the Guwahati Jail besides informing that his transfer to Tihar Jail will also reduce influence on witnesses.

However, Meghen’s counsel objected the request stating that it was illegal to transfer an under trial prisoner from one state to another besides the transfer is beyond the provision of the 1950 Jail act. The counsel further refuting the allegation against him, informed that jail was a state subject.

The counsel also informed the court that there were no records of Meghen’s wrong doing in the Jail manual.

After hearing from both the counsel the special judge of NIA court AK Das, rejected the transfer plea stating that it was illegal and also citing lack of evidence to support the allegation made against RK Meghen.
