GHC orders termination of Addl Dir

IMPHAL, August 28: A ruling by Justice Tayenjam Nandakumar, Gauhati High Court, Imphal bench on Monday quashed an order of the State government appointing A Sarat Kumar Sharma as the additional director (Adult Education) with immediate effect.

The mentioned official was found in service even after his age of superannuation.

Saratkumar was appointed for the said post on December 29,2006 and has been serving since.

The case commenced following a petition filed by one Ningthoujam Somananda of Narankonjin Mayai Leikai, Imphal West complaining that the additional director had reached the retirement age on 8 January , 2011 as according to his date of birth which is January 8, 1951 but is still taking charge of office.

The court last ordered on August 17, 2012 that the post of the additional director is not a teaching post but is an administrative one. The age of retirement has been reached according to relevant documents provided to the court. In the regard, the court directed the government advocate appearing on behalf of the respondents to obtain instructions on how Saratkumar is still holding the post after having reached retirement age. The order was made answerable on August 27.

Following a hearing yesterday, the government advocate appearing for the respondents could not obtain the necessary instructions. It was stated by the advocate that the Under Secretary (DP) was requested to provide the orders but was not responded from the same till date.

Under the circumstances, the GHC passed an order that the appointment of Saratkumar should be terminated.
