HC cancels bail grant of accused in drug seizure case involving state commandos

IMPHAL, October 4: A day after the IFP reported that the High Court of Manipur had on Thursday cancelled the bail granted to the seven accused of the high profile Pallel Drug case, it is learnt that on the same day, the High Court had cancelled the bail order of the Special Court (NDPS Manipur) in a similar case of drug seizure.

A delayed report said that the Manipur High Court has cancelled the bail order of the special court (NDPS Manipur) granted to an accused arrested in another major drug seizure case at Pallel, involving an 11-team member of Manipur Police commandos.

The report said that the judgement was announced on Thursday by a single bench of N Kotishwar, Manipur High Court the same day wherein a bail for seven accused in high profile Pallel drug haul case, was cancelled.

The accused is identified as Lalhamingshang Mizo alias Menshang (30), s/o Khunkhuma Mizo of Moreh Ward number 2, who was arrested on May 9, 2013 under FIR No. 62(4)2013, KCGPS U/S 21/29 NDPS Act and 27 Arms Act.

The bail was granted by a special court (NDPS Manipur), on May 17 last. The High Court passed the verdict in response to a petition filed by the RS Reisang, Government Advocate, who challenged the bail order of the special court (NDPS Manipur).

In the petition, the Counsel of the Government stated that the special judge has exercised its judicial discretion arbitrarily and erroneously adding that it informed the High Court that a charge sheet was filed in connection with the case.

The court also directed the respondent to surrender before the special court (ND&PS) within one week from the day of the judgement and the state to be responsible to take him into custody.

The hearing for the case was held on September 23 last and was reserved.

It may be mentioned that on 28 April, 2013, a team of Thoubal police commandos led by SI L Dhanabir Singh along with his party conducted frisking and checking in front of Pallel police station new building and intercepted a Moreh bound convoy of a team of police commandos with a huge consignment of illegal drugs worth over 1.21 crore.

The team was headed by a Jemadar, identified as H Premananda Singh and SI B Debson. During the course of investigations, it was learned that the drugs were handed over to the team by Md Ali of Khongjom Patpal Lamkhai to be delivered to Lalhmingsanga Mizo at Moreh.

Subsequently, Lalhmingsanga was arrested though Md Ali, another prime suspect of the case is reportedly absconding.

The involved police personnel involved in the transportation had been arrested and remanded to judicial custody while others are on bail.
