Victim`s family unhappy with 3-yr RI for accused, to appeal in higher court

IMPHAL December 27: Unhappy after the Session Court Manipur East, awarded a murder accused with 3 years Rigorous Imprisonment, family members and supporters of the victim have decided to appeal a higher court.

The Session Court, Manipur East had today convicted Aribam Naobi alias Naocha Sharma of Kongpal Khunou Mayai Leikai accused of killing A Sunil to three years Rigorous Imprisonment.

Judge A Guneshor Sharma sentenced Naobi under the section 304 part-2 of Indian Penal Code for committing culpable homicide not amounting to murder.

On June 15, 2012, the victim A Sunil was riding his motorcycle Discover 125 and slightly hit Aribam (o) Abe wife of the accused at Kongba lairenpat near RMC cinema hall along the Kongba-Yairipok road around 7:30 pm. Abe received some minor injuries which anger her husband the accused who attacked Sunil with a stone lying nearby.

Sunil was rushed to the hospital after the attack, however had succumbed to his injury on the same night.

A chargesheet was filed against the accused at the concern police station following which the case was taken up. Accused Naobi was arrested by the police on July 7, 2012.

The accused has been slapped with a fine of Rs 10 thousand for offence punishable under section 304 part II and in default of payment the accused has to go to another three month rigorous imprisonment.

The period of 904 days which the accused has already undergone in the Sajiwa central Jail will be set of from the sentence, the judge had further said.

The court also directed the Member Secretary, Manipur state legal service authority to provide compensation of Rs one lakh under the Manipur Victim Compensation Scheme 2011 to the victim family.   

Meanwhile, unhappy with the short term of the convict, the JAC formed in connection with the death and family members of the victim have decided to take the case to a higher court.
