Accused still at large, HC rejects bail plea
IMPHAL, March 11: An alleged rapist Alam Razak Makakmayum, 28, son of Abdur Razak of Hatta Golapati, Imphal East has been denied anticipatory bail by the single bench of the Manipur High Court today. The accused had sent up explicit photos on facebook showing himself and a girl Nazma (name changed) in compromising postures.
The alleged culprit is still absconding but the Court has issued directive that the anticipatory bail petitioned by Abdur Razak. The case was registered by Lilong police under FIR number 1(1) 2014 under section 376/417/418/506/120-B/34 of the IPC, section 6 of IRWP Act 1986 and under section 72 of the IT Act, 2000. Further direction by the Court included that in event of arrest, the accused can be released on bail but the accused should make himself available to police investigation and interrogation, and that he or his family members will not threaten the victim among others.
The complaint mentions that Nazma of Lillong Mairenkhul was drugged and raped by the accused. They had known each other over the telephone but decided to meet in a hotel at Tura Supermarket, Meghalaya in August 2012. The victim had constantly urged the accused to elope with her after the said act but was not reciprocated.
Later, in December 2013, she saw photos on facebook showing her in sexual acts with Alam Rajak. She then urged the accused to remove the photos and to elope with her repeatedly. But, she was threatened by the father of the accused Abdur Rajak not to harass his son and it would not be safe for her if continued so.
A medical examination was conducted on the victim on January 6, 2014 at RIMS and her statement was also recorded at the JMIC of Thoubal district. Police on further investigation found that the accused person is accountable for his crimes but he had absconded. It was therefore prayed to Court that the anticipatory bail be rejected as several disturbances may occur and hamper further investigation.
