Prithiviraj`s case deferred till April 16

IMPHAL, April 7: A single bench of Justice N Kotishwar Singh, High Court of Manipur today reserved the verdict pertaining to an argument with regards to the election petition lodged against parliamentary secretary, YAS and Tourism, M Prithiviraj, to be announced on April 16.

The hearing of the case was held today at the court of Justice N Kotishwar, for the third time listed at the number 13 of the cause list.

Sources informed that during today’s hearing the counsels representing the respondent M Prithiviraj, further raised the argument put up in the previous for the inclusion of Returning Officer and Election Commission of India to participate in the case as separate parties (respondents).

Further in the argument, the respondent’s counsel questioned why the ECI and RO should not take part as respondents in this particular case when the same was allowed in India’s presidential election and Panchayati Raj election.

Countering the argument, the counsel of the petitioner said the provision is not entertained in case of MP and MLA elections under the guidelines and rules of the Election Commission of India.

Having heard the argument of both the counsels, the court stated that the verdict whether to include the RO and ECI in the case as respondents was reserved to be announced on April 16.

It may be recalled election petition No.1 of 2012 High Court Manipur was lodged by Pukhrem Saratchandra Singh, son of Koiremba Singh a candidate during the 10th Manipur legislative Assembly Election 2012, against parliamentary secretary YAS and Tourism, Mairenbam Prithvitraj in April 2012, with the then Guwahati High court for the MLA while filing his affidavit mentioned that he was an MBA passed out from Mysore University in 2003 and 2004.

The Mysore University had rejected that Prithiviraj was a student of the university.

While the petition was filed during the 10th Assembly election, Prithiviraj had also filed his affidavit as an MBA during the 9th Assembly election.
