Fresh writ petition filed on March 10 Dimapur killing

IMPHAL, May 17: A fresh writ petition has been filed at the Guwahati high court division regarding the alleged killing of three youth of the State by the Indian Army personnel on March 10, 2010.

Briefing media persons, the counsel of the petitioner senior advocate Khaidem Mani, informed that the petition (WP(c) 2481 /2014) was filed by Phijam Manikumar, elder brother of one of the victims, against the Union of India and top army personnel.

Earlier the same case was lodged with the High Court of Manipur but it had to be later withdrawn following the issue of jurisdiction.

The trio were allegedly abducted near Char mile Dimapur, Nagaland on March 10, 2010 and later their bullet ridden dead bodies were recovered in Lakhinjan area of Assam.

While the next hearing of the case has been scheduled on July 16, the court informed the respondents including Colonel Gopinath Shreekumar officer commanding 3rd corps intelligence and surveillance unit, presently posted at head quarter New Delhi in the case asking them to submit their counter affidavits.

The respondents of the case are Union of India through Defence Secretary, Ministry of defence; the state of Assam through its principal secretary Government of Assam, Assam Secretariat Dispur; the state of Nagaland through its Chief Secretary of Government of Nagaland, Indian Army headquarter through the chief of army staff south Block New Delhi and Colonel Gopinath Shreekumar the then officer commanding 3 corps intelligence and surveillance unit and presently posted at head quarter New Delhi, said Khaidem Mani.

Meanwhile this time, the petitioner has prayed for striking out the names of three respondents : Lt General Dalbir Singh Suhag then General Officer in Commanding head quarter 3 corps Indian Army now vice chief of Army staff, Brigadier Gadier Ashwani Kumar then General Staff (Artillery) head quarter 3 corps and Major General then Brigadier General Staff (Operation) head Quarter 3 Corps presently posted at Head quarter Delhi, as the three were directly not involved in the case.

But the three army officers will be summoned only when required.
